These Terms & Conditions ("Terms") govern your use of the website, services, and digital products provided by Azania Custom Technologies (Pty) Ltd(trading as Azania Web Studio) ("we", "us", "our"), a South African business. By accessing the site, requesting a quote, or purchasing any project tier, you ("you", "Client") agree to these Terms.
1. Acceptance
By continuing to use our website or by completing a deposit payment for any service tier, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the service.
2. Who You Are Contracting With
Your contract is with Azania Custom Technologies (Pty) Ltd, the seller and service provider. Azania Web Studio is a trading division of Azania Custom Technologies (Pty) Ltd.
3. Services Provided
We design, architect, and build custom websites and web applications under three core tiers (The Launchpad, The Studio Growth, The Custom Commerce), along with bespoke engagements. Specific scope, deliverables, and timelines are agreed in writing per project before work commences.
4. Authority & Accuracy
You confirm you are at least 18 years old and, where contracting on behalf of a business, that you have authority to bind that business. You agree to provide accurate, complete information (including contact and billing details) and to keep it up to date.
5. Payment Terms
Payments are processed through PayFast, a South African payment gateway. Azania Custom Technologies (Pty) Ltd is the seller of record for all orders and is responsible for the delivery of services, customer support, and the handling of any refunds in line with our Refund Policy.
PayFast handles card and EFT payment processing under their own Terms of Use and Privacy Policy. We do not store full card data on our systems.
All project tiers require a 50% deposit to activate. The remaining balance is invoiced upon final delivery and handoff. All prices are quoted in South African Rand (ZAR).
6. Intellectual Property
All software, source code, templates, design systems, documentation, and branding owned by Azania Custom Technologies (Pty) Ltd remain our exclusive property. On full payment of all fees, you receive a perpetual, non-exclusive license to use the final deliverables produced specifically for your project. Background tools, frameworks, and reusable components remain our IP.
7. Acceptable Use & Misuse
You must not, and must not permit others to:
- Use our services for any unlawful purpose, fraud, or spam;
- Infringe any third-party intellectual property or privacy rights;
- Interfere with the security of our systems, attempt to probe, scan, scrape, or introduce malware;
- Reverse engineer, resell, or redistribute our proprietary code outside the agreed license;
- Circumvent technical or access controls on the service.
8. Service Level
While we strive to deliver high-performance, reliable work, we do not guarantee that the service or any deliverable will be uninterrupted, error-free, or fit for every particular purpose. To the fullest extent permitted by law, all implied warranties are disclaimed.
9. Suspension & Termination
We may suspend or terminate access to our services, withhold deliverables, or terminate an engagement in the event of: (a) material breach of these Terms; (b) non-payment of fees; (c) suspected fraud, abuse, or security risk; or (d) repeated or serious violations of our Acceptable Use rules.
10. Liability
To the maximum extent permitted by law, our aggregate liability arising from or related to these Terms or any project is capped at the fees paid by you in the preceding 12 months. We exclude liability for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
12. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the service after changes constitutes acceptance.
